THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

This Notice is provided by Plastic Surgery of Palm Beach, P.A. in connection with the Palm Beach Metabolic Care program.

How we may use and disclose your health information

For treatment: so the clinicians involved in your care can see the information they need.

We may use and disclose your protected health information for payment purposes (for example, to bill and collect for membership and clinical services, to obtain prior authorizations, and to assist with manufacturer savings programs when available) and for health-care operations (for example, quality assessment, care coordination, training, and administrative activities necessary to run the practice and the Palm Beach Metabolic Care program). Billing and related payment activities are performed using our practice-management system (Nextech), which is a Business Associate operating under a Business Associate Agreement. These uses and disclosures are permitted by HIPAA without your written authorization when they fall within the definitions of payment and health-care operations.

Your rights regarding your health information

To inspect and obtain a copy of your record.

To request a correction.

To request an accounting of certain disclosures.

To request restrictions on certain uses and disclosures.

To request confidential communications.

To receive a paper copy of this notice.

To be notified if there is a breach of your unsecured health information.

You have the rights granted by the HIPAA Privacy Rule, including the right to request access to and copies of your protected health information, to request amendments, to request restrictions on certain uses and disclosures, to request confidential communications, and to receive an accounting of certain disclosures. Requests are handled by the practice. Please note that our current systems record who creates or changes a record but do not automatically generate a complete log of every individual who has viewed a record; therefore an automated accounting of all disclosures is not available. We will respond to requests for an accounting of disclosures to the extent our records permit, consistent with HIPAA requirements.

How your information is protected here

Your record is held on a server controlled by the practice, not with a third-party health-records vendor.

Connections are encrypted. Access to administrative systems is restricted to the practice’s private network.

Backups are encrypted before leaving the server, with a key the server does not hold.

Changes to your record are logged, including who made them and when.

Complaints

If you believe your privacy rights have been violated, contact us at (561) 972-8002. You may also file a complaint with the U.S. Department of Health and Human Services. You will not be penalised for filing a complaint.
